TERMS AND CONDITIONS OF PARTICIPATION IN BOOK/COURSE

1. GENERAL

(A) These Terms and Conditions are governed by the laws of Singapore and the Parties irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of Singapore.

(B) All disputes, controversies or differences arising out of or in connection with the Terms and Conditions of this Course, including any questions regarding its existence, validity or termination, shall first be referred to the Singapore Mediation Centre (“SMC”), in accordance with SMC’s Mediation Procedure in force for the time being. Either Party may submit a request to mediate to SMC upon which the other party will be bound to participate in the mediation within 45 days thereof. Every Party to the mediation must be represented by a person with authority to negotiate and settle the dispute. Unless otherwise agreed by the Parties, the Mediator(s) will be appointed by SMC. The mediation will take place in Singapore in the English language and the parties agree to be bound by any settlement agreement reached.

2. DECLARATION BY PARTICIPANT

I, the participant of the Book/Course, hereby declare:

(A) Where and if I am making this purchase as a person who currently resides in Singapore, I confirm that I am:

(i) not a GST-registered customer and will not be claiming any input taxes on this purchase; or

(ii) I am a GST-registered customer and understand that the event that I will be making input tax claims, I will have to email contact@tradersgps.com within 24 hours from the payment date with the subject title, "Request for Tax invoice" and include my GST registered entity name, registration number and registered address, failing which, I accept that SF5 Pte Ltd will deem myself to be a non-GST registered customer;

(B) Where and if I am making this purchase as a person who currently does not reside in Singapore:

(i) I confirm that I have been absent from Singapore for a continuous period of at least one year with the exception of any temporary return to Singapore for vacation or other reasonable purposes and I reside permanently overseas; or

(ii) I am currently working overseas, my overseas assignment is not related to my employment in Singapore. For example, an individual sent to work overseas by his/her local employer, and I am residing overseas for the entire duration of the purchase and usage with regards to the purchase of this product and/or service.

3. ACKNOWLEDGEMENT BY PARTICIPANT

I, the participant of the Book/Course, hereby acknowledge and agree that: 

(A) SF5 Pte Ltd will be providing to me investing and trading strategies education workshops, training seminars and courses for the purpose of investing in and trading of financial equities, instruments and/or derivatives (the “Course”), and licensing software, programmes and algorithms to me (the “Services”).

(B) In consideration of the provision of the Services, I expressly agree and undertake that neither SF5 Pte Ltd nor its directors, officers, employees or agents (collectively, the “Indemnified Persons”) shall be held liable for any special, indirect or consequential loss or damage of any kind whatsoever (including but not limited to lost profits) as a result of:

(i) any act or omission whether due to negligence or otherwise in the provision of Services or the conduct of the Book/Course by the Indemnified Persons:

(ii) I as Participant implementing or executing any investing and trading strategies imparted by the Company during the Book/Course;

(iii) any computer viruses downloaded into any computer or internet access device as a consequence of downloading any materials, images or data by me for participation in the Book/Course or provision of the Services.

(C) SF5 Pte Ltd is not acting as advisor to me in relation to accounting, financial, tax, regulatory or legal matters and SF5 Pte Ltd is not advising me concerning the suitability of any securities or any investment strategy.

(D) All materials and information provided by SF5 Pte Ltd to me regarding the Book/Course belong to SF5 Pte Ltd and may not be posted, copied, distributed, uploaded or reproduced in any manner whatsoever without SF5 Pte Ltd’s prior written consent.

(E) I shall not post any comments or reviews online or via social media regarding SF5 Pte Ltd, the Book/Course or the Services which contain any defamatory, libelous, offensive, indecent or otherwise unlawful material which is an invasion of privacy. I understand that SF5 Pte Ltd reserves all rights to take such action (including but not limited to legal proceedings) as SF5 Pte Ltd deems fit in such event.

4. FEES AND EARLY ACCESS TO BOOK ENTITLEMENTS

(A) The total fees payable for the Book shall be reflected in their respective payment page where it shows the total fee payable of $32 or prevailing price.

(B) An order for the Systematic Trader® Book (“SMT™ Book”) will be secured for the Participant only after full payment is made and received by SF5 Pte Ltd.

(C) Each Main Participant who paid $32 is entitled to 5 complimentary bonuses consisting of the ETF masterclass, Trading Psychology masterclass, The Systematic Trading Community Access, ​Monthly Market Outlook Webinars, and ​Market Timing Wizard Fast Start Video Course.

(D) All sales of our book are final. We do not offer refunds, returns, or exchanges for any reason, including but not limited to dissatisfaction with the content, format, or delivery of the book.

(E) In the unlikely event that you encounter technical issues with the purchase or the delivery of the book, please contact our customer support team providing detailed information about the problem you are experiencing. We will make reasonable efforts to resolve the issue and ensure you receive the book as intended.

(F) Any unauthorized distribution, reproduction, or sharing of the book, in part or in whole, without the prior consent of SF5 Pte Ltd. is strictly prohibited and may result in legal action.

(G) SF5 Pte Ltd will not be responsible for any missing and/or damaged mail in circulating the SMT™ Book to the Participants.

5. DEPOSITS AND PAYMENT MODE      

(A) To secure promotional Book fee prices, full payment of $32 is required from each Participant.

(B) Any fees payable will be made to SF5 PTE LTD or the venue agent that has been nominated by SF5 PTE LTD. Payment can be made through either funds transfer, online payment or credit card.

6. COURSE SCHEDULE

(A) SF5 Pte Ltd will use reasonable endeavours to arrange for an appropriate delivery date suitable for the Participant.

(B) If you wish to reschedule the delivery date of your book, kindly contact our customer support team as soon as possible. Rescheduling requests can only be accommodated if the book has not been dispatched for delivery.

(C) A Participant may reschedule the delivery for a maximum of 1 time(s). While we will make every effort to accommodate your request, we cannot guarantee an alternative delivery date if our inventory or logistical constraints do not permit it.

7. ENTIRE AGREEMENT

These terms and conditions constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all previous understandings, representations, proposals and discussions, whether oral or written, between the parties concerning the subject matter hereof. All rights of SF5 Pte Ltd hereunder are separate and cumulative and not one of them, whether or not exercised shall be deemed to be an exclusion of any of the other rights and shall not limit or prejudice any other legal or equitable right which SF5 Pte Ltd may have.
